Newsletters are released over the course of the year to our clients as

In addition to our normal newsletter updates, we at Pointon Partners have developed seven checklists for business. The checklists have been created to meet a desire that many of our clients have expressed to us over the years to have lists of relevant issues to themselves presented to them so that they may be pro-active in tending to best practice for their legal needs and responsibilities. The checklists cover issues that should be considered by most people in business, but often are not. They are provided free of charge as part of our ongoing commitment to our clients upon request, but are not published on our website.

Stamp Duty on commercial leases had been abolished in Victoria
in 2001. However, due to the Duties Amendment Act (2009)
a number of leasing transactions may become subject to
stamp duty.
Provisions of the Fair Work Act 2009 (‘the Act’) came into effect as
of July this year, and one of the most significant changes is to
Unfair Dismissal Laws.

In the recent case of Ascot Four Pty Ltd v ACCC [2009] FCAFC 61,
the Full Federal Court dismissed appeal by a retail business
owner against a finding that in a Christmas catalogue contained

“Off the plan” contracts for the sale of land in Victoria are under
attack. An example of this is the recent decision of Bongiorno J in Clifford 7 Anor v Solid Investments Australia Pty Ltd [2009] VSC 223 where the court held that a right to extend the time to register the plan of subdivision for an indefinite period was invalid.
Golden Handshakes - In June 2009 the Federal Government
introduced the Corporations Amendment Improving Accountability on Termination Payments Bill [2009]. This proposes a major reform to the law in relation to termination payments for executives for companies of all sizes.
